Challenge Your Record

Challenge Your Record

You have the right to challenge the completeness and accuracy of your Utah criminal history record. If you believe your record contains incorrect information—such as an error in your personal details, an inaccurate arrest entry, or a record belonging to another person due to identity theft—you may submit a formal challenge to the Bureau of Criminal Identification (BCI).

Please Note: Submitting a formal record challenge application initiates a research review but does not guarantee a specific administrative outcome or automatic removal of entries.

What is a Record Challenge?

If your record contains verified errors, you can challenge the Bureau of Criminal Identification (BCI) to review and correct three specific types of data:

  • Identification Information: You may challenge inaccuracies in your personal profile, including your legal name, date of birth, social security number, or other identifying physical descriptors.
  • Disposition & Case Info: You can correct missing or wrong information regarding past cases—for example, if a case was officially dismissed by the court but is still incorrectly showing as a conviction on your record.
  • Identity Challenges: Systematically removing criminal records that were wrongly attached to your name due to data entry clerical error or verified identity theft.

What You Will Need

Before starting your application, ensure you have the following requirements ready:

  • Valid Photo ID: A current, unexpired government-issued ID (e.g., Driver License or Passport). Note: Utah Driving Privilege Cards are not accepted.
  • Supporting Documentation: Certified court dockets, official letters from law enforcement agencies, or comprehensive identity theft police reports.
  • Fingerprints: You must have a physical fingerprint card taken by a certified law enforcement official or directly at the BCI headquarters office to securely verify your identity.
  • Application Fee: A $20.00 non-refundable administrative processing fee.

Challenge Results

After the Records team finishes the auditing process, you will receive an official determination letter detailing the results of the challenge. If your record was updated, a newly corrected copy of your Utah criminal history record will be sent to you.

If you wish to appeal the challenge results, you may formally appeal BCI's decision under Utah Code 63G-4-402 within 30 days of the issuance date printed on the challenge decision letter.

Challenge Documentation

Providing comprehensive supporting documentation helps BCI review your official record challenge more accurately and efficiently. Official entries such as verified court dockets, signed judicial orders, formal booking sheets, and certified letters issued directly by a court clerk or a prosecutor’s office will help verify the precise information you believe is incorrect and substantiate the correction you are requesting.

Use the administrative tool detailed below to quickly determine what specific types of primary documentation may be most helpful to attach to your completed application packet.

Question 1

What are you trying to challenge?

Select all that apply. If you are only challenging identity and believe the record does not belong to you, you do not need to submit court or case paperwork.

Question 2

Do you have a Request of Access (ROA) or a copy of your criminal history?

This is strongly recommended for arrest/booking or court case challenges, but it is not required. If you have one, highlight the information you believe is wrong.

Question 3

Do you have any supporting documentation?

Examples include court dockets, booking sheets, letters from the court, letters from the prosecutor’s office, plea paperwork, signed orders, or other official documents.
